Acceptance of Terms

  • By accessing or using Kestrel EHS, you agree to these terms.
  • If you're using Kestrel EHS on behalf of a company, you represent that you have authority to bind that company.

Description of Service

  • Kestrel EHS is a web-based Job Hazard Analysis (JHA) platform.
  • The platform is provided “as is” and we continuously improve it.
  • Features may be added, modified, or removed as the product evolves.

Accounts and Registration

  • You're responsible for maintaining the security of your account credentials.
  • You must provide accurate information during registration.
  • One person per user account — account sharing is not permitted.
  • You must be at least 18 years old to use the service.

Acceptable Use

  • You agree to use Kestrel EHS only for its intended purpose: creating and managing Job Hazard Analyses.
  • You will not attempt to gain unauthorized access to other users' data or the platform's infrastructure.
  • You will not use automated scripts or bots to create accounts or JHAs (beyond normal platform use).
  • You will not use the platform for any unlawful purpose.

Your Data

  • You retain ownership of all JHA data you create on the platform.
  • We do not claim intellectual property rights over your content.
  • You grant us a limited license to store, process, and display your data as necessary to provide the service.
  • You are responsible for the accuracy of JHA content — Kestrel EHS is a tool to assist with hazard analysis, not a substitute for professional safety judgment.

Safety Disclaimer

  • Kestrel EHS is designed to assist with Job Hazard Analysis creation, NOT to replace qualified safety professionals.
  • The platform provides guided workflows and suggestions but does not guarantee the completeness or accuracy of any JHA.
  • You are solely responsible for ensuring workplace safety and regulatory compliance.
  • Kestrel EHS is not liable for workplace incidents, injuries, or regulatory penalties.
  • Always have qualified safety personnel review JHAs before use in the field.

Subscriptions and Payment

  • Paid subscriptions are billed monthly or annually through Stripe.
  • All fees are non-refundable except as required by law.
  • We offer a 14-day free trial — no credit card required.
  • We may change pricing with 30 days' notice to existing subscribers.
  • If payment fails, we will attempt to notify you before restricting access.

Cancellation

  • You can cancel your subscription at any time through the billing portal.
  • After cancellation, you retain access until the end of your current billing period.
  • Your data remains accessible in read-only mode after cancellation.
  • We retain your data for 90 days after account deletion, then permanently delete it.

Limitation of Liability

  • Kestrel EHS is provided “as is” without warranties of any kind.
  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
  • We do not guarantee uninterrupted or error-free service.

Termination

  • We may suspend or terminate accounts that violate these terms.
  • We may terminate accounts for non-payment after reasonable notice.
  • Upon termination, you can request a copy of your data within 30 days.

Changes to Terms

  • We may update these terms from time to time.
  • Continued use of the platform after changes constitutes acceptance.
  • We will notify you of significant changes via email.
